Puppy Contract
Deposit, Payment of Purchase, Price, Fees
Buyer has paid a deposit of $_________, with payment of the balance of $_________ due upon release of the Dog to Buyer. The expected delivery date is _____________, or such other date that are mutually agreed by both parties. Payment of the balance may be made by cash, cashier’s check or bank transfer.
Buyer acknowledges and agrees that Buyer will forfeit the deposit and any rights to the Dog if:
Buyer fails to complete the purchase of the Dog for any reason, or
Buyer fails to pay the balance of the Purchase Price on the day of the agreed delivery date.
Buyer fails to comply with pre-screening requirements as agreed upon during pre-screening session.
In either event, Seller shall be free to sell the Dog to another party.
In the event that the Dog is not available due to sickness, death, or any other circumstance owing to the fault of Seller, Buyer’s deposit will, at Buyer’s option, be either (i) refunded, or (ii) transferred to the next batch of puppies imported by Seller.
A boarding fee of $_________ per day will be charged for each day the Dog is boarded by Seller past the agreed delivery date.
Transfer of Ownership and Registration
Upon payment in full of the Purchase Price, Seller shall promptly take all actions required to officially transfer ownership and registration (if any) of the Dog to Buyer.
Buyer would be required to pay for the licensing fee as implemented by AVS.
Seller’s Representations and Warranties
Seller represents and warrants to Buyer that:
Seller is the legal and true owner of the Dog and that Seller has full right and authority to sell the Dog
The Dog is being sold free and clear of any security interest, charge or other encumbrance.
The Dog is in good health and free of communicable disease at the time of this sale. Buyer has 2 days from the delivery date to have the Dog examined by a licensed veterinarian, at Buyer’s sole cost. If the Dog fail the examination, Buyer may return the Dog, with a written statement from the veterinarian, for a full refund. Failure by Buyer to have the Dog examined within the 2 day period will nullify the warranty. If Buyer chooses to keep the Dog, no replacement and no refund will be given and all medical costs and treatment are the sole responsibility of the Buyer. This health guarantee will be null and void.
This Guarantee does not cover issues like Cherry eye, Entropion, Ectropion, Allergies, undescended testicles, loose knees or hips, Stenotic nares, elongated soft palate, umbilical hernia, dermatitis, demodectic mange and all other health problems that the purchased Dog is predisposed to, upon release of the Dog. Seller will not replace a puppy due to heat stroke, abuse/neglect, or improper socialisation. Buyer agrees that they have thoroughly researched the breed of the Dog purchased, and understand the many health issues they can possess. Buyer is responsible for all medical costs of their puppy. (No refunds will be given). This guarantee covers only the original Buyer and is not transferable.
Buyer agrees to not euthanize the dog for reasons other than medical in nature. In the scenario where Buyer loses the capacity to care for the dog, Buyer agrees to put Seller as the first consideration for the custody of the dog.
Fitness of Purpose
The Dog was sold as a companion animal unless otherwise agreed between both parties. Seller does not provide any warranty as to the Dog’s fitness for any specific purpose, including obedience trials and show ring performance.
Only upon agreement between both parties, can the Dog be shown in show ring performance.
Buyer’s Representations
Buyer represents to Seller that:
Buyer will have the Dog spayed or neutered by the age of ______ months. Buyer will have to produce proof of desexing to Seller, by the agreed age unless prior discussion is carried out for an exemption for reasons other than breeding.
Buyer will not breed the Dog for any purposes unless with written permission by the Seller. Any breeding of the Dog found by Seller gives Seller all rights to report to the authorities (AVS/Nparks)
The Dog will reside with Buyer as a companion pet to Buyer and Buyer’s family.
Buyer will keep the Dog in an enclosed area of adequate size, and will not allow the Dog to roam at will outside of Buyer’s premises. Buyer will also not keep the Dog chained or tethered or permanently housed in a kennel.
Buyer will provide the Dog with nutritious food and necessary veterinary care, including deworming, heartworm prevention and regular vaccination/titer test.
Buyer is not acting as an agent for any person or business in the purchase of the Dog.
Buyer will not sell, give, lease or release the Dog to a pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility.
In the event Buyer wishes to sell/release the Dog to a new owner, Buyer shall ensure that this is
done only after consultation with Seller. Buyer agrees to make all effort to ensure the rehoming process is carried out in such a way that the new owners would have access to the continual support that the Seller intends to provide.
Buyer understands that every dog has his/her own personality and seller makes no guarantees on the personality of the dog.
Should it be proven with sufficient evidence (AVS/NPARKS) that the dog was neglected/abused, buyer agrees to enter into a discussion with the seller regarding the appropriate transfer of ownership to a new owner with mutual agreement between the buyer and seller.
Indemnity and Release
Buyer releases Seller from any and all liability, costs or damages caused by the Dog after placement with Buyer, including but not limited to damage to or destruction of property, and injury to any person.
Limitation of Action
Any action or claim brought by Buyer against Seller for breach of this Agreement or for loss due to negligence must be brought within one (1) year of the date such claim or loss occurs.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Singapore.
Entire Agreement
This Agreement and all pre-screening terms and conditions represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.
